a. This website (“Website”) is owned and operated by DYNAMIC GAMING SOLUTIONS, LLC. Throughout the Website, the terms “We,” “Us.” and “Our” refer to DYNAMIC GAMING SOLUTIONS, LLC located at 5300 S. Portland Avenue, Oklahoma City, Oklahoma, 73119. DYNAMIC GAMING SOLUTIONS, LLC offers this Website, including all information, parts, and services available from this Website to you (“You,” “Your”), the user, conditioned upon your acceptance of these Terms and Conditions. By accessing or using any part of the Website, you agree to be bound by these Terms and Conditions.

b. These Terms and Conditions apply to all users of the Website, including, without limitation, users who are browsers, vendors, customers and merchants.

c. Please read these Terms and Conditions carefully before accessing or using Our Website. Your access to and use of the Website and any order(s) placed for parts with DYNAMIC GAMING SOLUTIONS, LLC are subject to these Terms and Conditions. You agree that you will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website, you are fully accepting the terms, conditions and disclaimers contained in these Terms and Conditions. If you do not accept these Terms and Conditions, you must immediately stop using the Website and must not place any orders for parts with DYNAMIC GAMING SOLUTIONS, LLC.

d. Please note that We only provide parts to licensed casinos and/or licensed entities. We do not provide parts to anyone else. Telephone support and/or email support is generally available between 9 am and 5 pm Central Time zone, Monday through Friday. We test all parts prior to shipment. The parts we ship are in good working condition.

e. We carry a large amount parts in stock and it would be impossible to list them all here. If You need a slot machine part that We don’t have, We can try to source it.

2. Credit Card Details
​
a. DYNAMIC GAMING SOLUTIONS, LLC accepts Visa, Mastercard, American Express and Discover on Our Website for parts orders. All credit card transactions are processed securely. Credit card numbers are used during the checkout process. For your protection, credit card information is not stored by DYNAMIC GAMING SOLUTIONS, LLC.

b. During the checkout process, an authorization is made on Your credit card, however the charge is not finalized (captured) until the order is fulfilled. If for any reason DYNAMIC GAMING SOLUTIONS, LLC, is unable to fulfill the order (including because the item is out of stock or unavailable) Your credit card will not be charged. In this situation, the authorization will be voided and the funds will become available on the cardholder's account within 5 business days.

3. Accuracy of Website. The contents of this Website do not constitute advice and should not be relied upon in making or refraining from making, any decision. We are not responsible if information made available on this Website is not accurate, complete or current. The material on this Website is provided for general information only. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the Website is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information on the Website, including without limitation, pricing information, except as required by law.

9. Severed Terms and Conditions. If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

10. Choice of Law and Venue, Jury Trial Waiver, Attorney’s Fees and Costs.

a. Choice of Law and Venue. You and DYNAMIC GAMING SOLUTIONS, LLC agree that these Terms and Conditions will be interpreted and governed by the laws of the U.S. state of Oklahoma. You and DYNAMIC GAMING SOLUTIONS, LLC consent to and submit to the jurisdiction and venue of the Oklahoma state court(s) located in the city of Oklahoma City, county of Oklahoma, state of Oklahoma, and/or the U.S. District Court for the Western District of Oklahoma for any disputes and/or litigation arising out and/or relating to the Website or any parts ordered from DYNAMIC GAMING SOLUTIONS, LLC.

b. Jury Trial Waiver. YOU AND DYNAMIC GAMING SOLUTIONS, LLC EACH KNOWINGLY AND VOLUNTARILY HEREBY IRREVOCABLY WAIVE ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF AND/OR RELATED TO THE CONTRACT DOCUMENTS.

c. Attorney’s Fees, Costs and Expenses. You agree that We are entitled to reasonable attorney’s fees, costs, and expenses expended in any legal action we take against You and/or that we have to defend against arising out and/or relating to the Website or any parts ordered from DYNAMIC GAMING SOLUTIONS, LLC.

11. Warranty
​
a. Used and/or Refurbished Parts - Unless specifically stated otherwise on the applicable parts order, all used and/or refurbished parts carry a thirty (30) day warranty against defects. The warranty period begins on the day the buyer receives the used and/or refurbished part(s). The 30-day warranty against defects on used and/or refurbished parts is that the part(s) will be free from defects in material and workmanship that materially and adversely affect the performance of the used and/or refurbished part(s). Deviations from any specifications or standards that do not materially affect the performance of the used and/or refurbished part(s) are not considered to be defects in materials or workmanship. The sole and exclusive remedy of the buyer of the used and/or refurbished part in the event of defect is expressly limited to the adjustment, repair, or replacement of defective used and/or refurbished parts to return the used and/or refurbished part(s) to good working condition, in the sole discretion of DYNAMIC GAMING SOLUTIONS, LLC or if unable to be adjusted, repaired or replaced for You to be or refunded the amount of the part, in the sole discretion of DYNAMIC GAMING SOLUTIONS, LLC. The warranty for used / refurbished parts does not apply to any parts damaged and/or made inoperable by electrical issues / electrical surges.

b. Gaming Parts ("As Is" Condition) "As Is" parts carry no warranty whatsoever. These parts are offered at a reduced price and are recommended for buyers that have the necessary skilled technical staff to support, troubleshoot, reconfigure, and repair the parts as necessary.

c. New Manufacturer Parts warranty. Unless specifically stated otherwise on the applicable parts order, all new manufacturer parts carry a ninety (90) day warranty against defects (“New Manufacturer Parts Warranty”). The New Manufacturer Parts Warranty against defects on new manufacturer parts is that the new manufacturer part(s) will be free from defects in material and workmanship that materially and adversely affect the performance of the new manufacturer part(s). Deviations from any specifications or standards that do not materially affect the performance of the new manufacturer part(s) are not considered to be defects in materials or workmanship. The sole and exclusive remedy of the buyer of the new manufacturer part(s) in the event of defect is expressly limited to the adjustment, repair, or replacement of defective new manufacturer parts to return the new manufacturer part(s) to good working condition, in the sole discretion of DYNAMIC GAMING SOLUTIONS, LLC or if unable to be adjusted, repaired or replaced for You to be or refunded the amount of the new manufacturer part, in the sole discretion of DYNAMIC GAMING SOLUTIONS, LLC.

d. New Aftermarket Parts warranty. Unless specifically stated otherwise on the applicable parts order, all new aftermarket parts carry a ninety (90) day warranty against defects (“New Aftermarket Parts Warranty”). The New Aftermarket Parts Warranty against defects on new aftermarket parts is that the new aftermarket part(s) will be free from defects in material and workmanship that materially and adversely affect the performance of the new aftermarket part(s). Deviations from any specifications or standards that do not materially affect the performance of the new aftermarket part(s) are not considered to be defects in materials or workmanship. The sole and exclusive remedy of the buyer of the new aftermarket part(s) in the event of defect is expressly limited to the adjustment, repair, or replacement of defective new aftermarket parts to return the new aftermarket part(s) to good working condition, in the sole discretion of DYNAMIC GAMING SOLUTIONS, LLC or if unable to be adjusted, repaired or replaced for You to be or refunded the amount of the aftermarket part, in the sole discretion of DYNAMIC GAMING SOLUTIONS, LLC.

e. The warranties listed in section 11 are void if the part(s) are not operated and maintained in accordance with parts manufacturers’ product literature and manuals and/or is operated in violation of law. The warranties listed in section 12 grant specific legal rights, but You may have other rights that vary from state to state. Some states do not allow limitations on how long an implied warranty lasts, and some states do not allow the exclusion or limitation of incidental or consequential damages. EXCEPT AS SPECIFICALLY SET FORTH HEREIN, ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, ARE EXCLUDED FROM ANY PARTS SALES, INCLUDING WARRANTIES OF FITNESS FOR A PARTICULAR USE AND MERCHANTABILITY, AND THOSE ARISING UNDER USAGE OF TRADE, COURSE OF DEALING, OR COURSE OF PERFORMANCE. NO AFFIRMATION OF FACT, INCLUDING BUT NOT LIMITED TO STATEMENTS CONCERNING SUITABILITY OF USE PERFORMANCE OF ANY PARTS SHALL BE DEEMED TO BE A WARRANTY OR GUARANTEE FOR ANY PURPOSE.

f. Warranties not Transferable. All warranties listed in this Section 11 are non-transferable.

g. Exclusions from Warranties listed in this Section 11: Aside from during initial shipping - breakage of glass and/or monitors, light bulbs, fuses, starters; damage caused by intentional abuse and/or misuse of any part; damage caused by faulty electrical circuits and/or electrical surges and/or lightning; physical damage and/or abuse to any part or any component; damage caused by temperature such as extreme heat (more than 90 degrees Fahrenheit) and/or extreme cold ( less than 30 degrees Fahrenheit); damage caused by water, spills, humidity or any liquid, food or other substance, smoke or tobacco; damage caused by dropping, moving or tipping any machine or part thereof; damage caused by adding any unauthorized component or repair; damage caused by any Acts of God, including but not limited to: dust storms, earthquakes, flooding, hurricanes, lightning, tornados and thunder; damage caused by alternations and/or modifications to any part and/or machine; damages due to maintenance and/or cleaning of any part or machine; damage to a part and/or machine caused by misuse; and any on-site labor and/or travel expenses by Us related to the warranties listed herein. If We test an electrical component part upon receiving the part as a return and it is no longer operational due to electrical issues then that part is excluded from Warranty coverage and the part will be made available to ship back to You at your sole expense.

h. It is Your responsibility to verify that using used and/or refurbished and/or new aftermarket parts supplied by US does not void any warranties You currently have on your gaming equipment.

12. Johnson Act and Jurisdictional Regulations
​
a. All orders are subject to approval before shipping, including orders processed on the Website, by phone or in person. If an item is found to be out of stock and cannot be sourced, DYNAMIC GAMING SOLUTIONS, LLC will contact the customer and refund the customer's purchase to the same credit card used during the checkout process.
​
b. All orders shipped within the United States are subject to the Johnson Act, 15 U.S.C. 1711. This legislation is enforced in the sale, transfer and transport of certain gaming parts and equipment including: complete games, logic boards (MPU, Motherboards, etc.) and software that can influence or change the outcome of a game. In these cases, the buyer must present DYNAMIC GAMING SOLUTIONS, LLC with proof that the buyer possesses a valid license to possess, transfer and/or operate gaming equipment within their jurisdiction prior to releasing their order. DYNAMIC GAMING SOLUTIONS, LLC may refuse to sell any parts to You if DYNAMIC GAMING SOLUTIONS, LLC is required to have a specific license to sell parts to You. You have the obligation to determine if any licensure of DYNAMIC GAMING SOLUTIONS, LLC is required to sell parts to You and you must inform DYNAMIC GAMING SOLUTIONS, LLC in writing of any required licensure to sell parts to You.

c. You agree not to redistribute or resell any of the parts or equipment purchased from DYNAMIC GAMING SOLUTIONS, LLC without prior written approval from DYNAMIC GAMING SOLUTIONS, LLC and the submission of proof to DYNAMIC GAMING SOLUTIONS, LLC that the buyer possesses all the necessary legal documentation including but not limited to: Department of Justice letter (Johnson Act, 15 U.S.C. 1711) and jurisdictional permits and licenses.

d. You and any buyer agree to indemnify and hold DYNAMIC GAMING SOLUTIONS, LLC and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against DYNAMIC GAMING SOLUTIONS, LLC arising out of any breach by you or any buyer of these Terms and Conditions or other liabilities arising from non-compliance with the Johnson Act or any Local, State or Federal laws and/or regulations.

13. Right to Refuse Service

a. We reserve the right to refuse service to anyone for any reason at any time.

b. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Website, use of the Website, or access to the Website, without express written permission by Us.

14. Parts Availability

a. Any offer for any part on this site is void where prohibited. Certain parts may be available exclusively online through the Website. Parts may have limited quantities and are subject to return or exchange only according to Our Return policy stated herein. We have made every effort to accurately display the parts on Our website and are not responsible for any variation of colors and/or images. All descriptions of parts and parts pricing are subject to change at any time without notice, at Our sole discretion.

b. We reserve the right to limit the quantities of any parts that We offer. We do not warrant that the quality of any part or other material purchased or obtained by You will meet your expectations other than the warranties specifically stated herein. We reserve the right, but are not obligated, to limit the sales of Our parts to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to discontinue any part at any time.

15. Account Information / Accuracy of Billing Information. In the event that We make a change to or cancel an order, We will attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in Our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made from Us. You agree to promptly update Your account and other information, including Your email address, credit card numbers, and expiration dates, so that We can complete your transactions and contact You as needed. 16. Prohibited Uses. In addition to other prohibitions as set forth in these Terms and Conditions, You are prohibited from using the Website or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate Our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Website, other websites, or the Internet. We reserve the right to terminate Your use of the Website for violating any of the prohibited uses.

17. Shipping and Handling.

a. You are responsible for all shipping charges on any parts purchased from Us. Our policy is to ship all parts, whether new and/or used and/or refurbished, via the most convenient and economical way possible. We use USPS, FedEx, and UPS, among others, when applicable. Substitutions between comparable shipping methods may occur.

b. New and/or used parts ordered that are in stock will ship as soon as possible for DYNAMIC GAMING SOLUTIONS, LLC. Refurbished items that are in stock may need to be tested and can require additional processing time.

c. You are responsible for any insurance regarding shipping of parts from Us to You and from You to Us, if available.
​
18. Ownership of Parts / Risk of Loss. Ownership of parts & risk of loss transfers to the Buyer at Our dock (FOB: 5300 S. Portland Avenue, Oklahoma City, Oklahoma, 73119). In no event is DYNAMIC GAMING SOLUTIONS, LLC liable for any loss and/or damage incurred during or after shipment from Our shipping dock.

19. Core Exchange. If the Part you are buying from Us involves a core part (“Core Part”) than in addition to the price for the part You will pay a specified core charge “Core Charge” for the Core Part up front as part of the purchase price. If You return the old core to Us at your sole expense within thirty (30) days of your purchase from Us of the Core Part and We determine that the core part is usable, then We will refund the Core Charge to you within thirty days of Our receipt of the old core. If the old core part You return to us is not usable or damaged beyond repair then We will not refund the Core Charge to You.

20. Return / Exchange Policy. Returns and/or exchanges on parts, new and/or used and/or refurbished, are in the sole discretion of DYNAMIC GAMING SOLUTIONS, LLC. Any return / exchange agreed to by DYNAMIC GAMING SOLUTIONS, LLC shall be sent by You to Us at 5300 S. Portland Avenue, Oklahoma City, Oklahoma, 73119 by mail/delivery up to 30 days from original receipt of the part(s). Returns shall be subject to a twenty-five percent (25%) restocking fee. Buyer is responsible for all shipping costs, expenses & fees to return any part to Us. No refunds are granted unless the item(s) is/are returned in the original condition that they were in when originally shipped to Buyer by DYNAMIC GAMING SOLUTIONS, LLC.

21. Headings. The headings used in these Terms and Conditions are included for convenience only and will not limit or otherwise affect these Terms and Conditions.
